BURLEY, Idaho (KMVT/KSVT) - The Cassia County Prosecutor has moved to dismiss charges against Ronnie G. Kincaid III. A jury trial had been scheduled for April 11.

The teen was charged as an adult with being an accessory to murder and concealing or destroying evidence following the death of his stepmother, Melissa Kincaid. She was found dead in a rural Declo home on September 6. In court, Kincaid III, through his attorney, pleaded not guilty to the charges.

Prosecuting Attorney Douglas G. Abenroth said that in evaluating the state’s case and considering the time constraints imposed by the speedy trial requirements set forth by Idaho statute and the court, the state is exercising prosecutorial discretion to dismiss the case without prejudice as to protect the merits of the case in the future.

The charges were dismissed without prejudice which means the State is allowed to re-file the charges against the defendant at a later date. According to a news release the state plans to do just that “at the appropriate time.”
